The process of registering with the Tax Agency in Spain as a self-employed person involves several steps and the submission of certain documentation. Below is a step-by-step summary of the process:

Obtaining the NIF:

Before starting the process of registering as Autonomo in Spain, it is necessary to obtain a Tax Identification Number (NIF) if you do not already have one. You can get it from the Tax Agency.

Census Declaration (Form 036 or 037):

1. Filling out of Form 036 or 037: This form is the census declaration, and in it the Tax Agency is informed of the data relating to the starting, modification or cessation of the economic activity. You can obtain these forms in our downloadable section.
2. Personal and Activity Data: The form includes personal data, tax information, and the economic activity that you are going to carry out, among others.
3. Sign and Submit the Form: The form must be signed and submitted to the Tax Agency, either in person or online.

Social Security Affiliation:

Simultaneously to the process with the Tax Agency it is necessary to make the affiliation to the Special Regime for Self-Employed Workers (RETA) learn the complete process here.

Registration at the City Council (if necessary):

Depending on the activity and the location where it is carried out, it may be necessary to obtain an opening license from the corresponding City Council.

Note: The time it takes to complete these procedures may vary. Online presentation usually speeds up the process compared to in-person filing. In general, the NIF is expected to be assigned immediately, but confirmation of Social Security affiliation and other formalities may take a few days or weeks.

Yes, in Spain, the self-employed are obliged to keep accounts of their economic activities. The way of keeping these accounts may vary depending on the tax regime you are under.

  • Simplified Regime (Objective Estimation): In this regime, it is not necessary to keep detailed accounting records. Taxation is based on objective rates and accounting books are not filed quarterly.

  • General Regime (Direct Estimation): If you are in the general regime, it is mandatory to keep accounts according to the rules of the General Accounting Plan. You will have to present the corresponding tax forms quarterly and at the end of the fiscal year you will have to make the annual liquidation.
