How to Renew the Residence and Work Permit (Cuenta Ajena)

There are different types of authorizations, among them highlighting the residence and work permit for employment (cuenta ajena) or self-employment (cuenta propia) for non-EU citizens, or the residence permit for family reunification.

Each of the residence permits in Spain has its peculiarities, procedures and obligations. In order to be granted, to renew this work permit (cuenta ajena) for non-EU citizens you must meet certain requirements. There is also specific documentation that you must present.

Requirements and documentation to renew this work permit

During the 60 calendar days prior to the end of your residence and work permit, you can request its renewal. With the presentation of the renewal request, the validity of the permit is extended until you get a response.

Requirements

Once the fees for processing the authorization have been paid, you must meet one of these requirements:

• Continue working on the job that led to the granting of the permit.
• Having been working and being registered with Social Security for a minimum of nine months in a period of 12. Also if you have worked for a minimum of 18 months in a period of 24.
• Proof of carrying out the activity for a minimum of six months per year, being able to demonstrate that you have a new employment contract. You will have to provide evidence proving that you are registered or assimilated at the time of application. You can also submit a new job offer for a position with similar characteristics.
• You may apply for renewal if you have worked for a minimum period of three months per year, as long as you can prove that the employment relationship that gave rise to the authorization was interrupted through no fault of your own and you have actively sought employment. You will also need to have a valid employment contract at the time of submitting the renewal application.
• If at the time of renewing your work and residence permit as an employee, you are receiving a contributory pension. You can also request the renewal of the permit if you receive a public economic assistance benefit aimed at achieving your social or labor insertion.
• Another way to get the permit renewed is by proving that your spouse or civil partner has sufficient financial requirements to request your reunification.
• Finally, and as indicated on the website of the Ministry of Employment, if the employment relationship was suspended or terminated as a result of being a victim of gender violence, you can request the renewal of your permit.

In order to be granted the renewal of the permit, you must have no criminal record in our country, nor can you be prohibited from entering or being rejected in those countries with which Spain has signed an agreement.

Documentation to renew the residence and work permit

Regarding the documentation required for the renewal of the residence and work permit, highlight :

1. The official Form EX–03. You must present it in duplicate, completed, and signed. You can download Form EX-03 here.
2. A complete copy of the valid passport or travel title.
3. Copy of the documentation that accredits having the training and professional qualification legally required for the exercise of the profession.
4. NIF or NIE of the employer (individual).
5. Consent to verify the identity data through the Identity and Residence Data Verification System of the employer (natural person).
6. NIF of the employing company.
7. Deed of incorporation of the employing company.
8. Copy of the public document that proves that the signatory of the authorization request holds the legal representation of the company.
9. NIF or NIE of the company representative.
10. Consent to verify the data of the company representative through the Identity and Residence Data Verification System.
11. Signed employment contract.
12. Declaration of personal Personal Income Tax (IRPF), IVA, Corporate Tax, or the report on the company’s work history (VILE), referring to the last three years.
13. Descriptive recollection of the occupation to be carried out.
14. Last Personal Income Tax Return or income certification issued by the Tax Administration or other documentation proving sufficient solvency for hiring (employer = natural person).

For how long is the residence and work permit renewed?

In general, this work permit is renewed for two years, unless a permanent residence permit is granted. As for the response period of the Administration, if in three months they have not responded, it will be understood as approved by administrative silence.

The appropiate renewal of your work permit gives you the right to exercise any occupation anywhere in Spain.

Request the TIE

Once the renewal of your work permit has been granted, within one month of being notified you must apply for a new Foreigner Identity Card (TIE) at the Immigration Office or Police Station in the province where you will be renewing. There you will be required to provide the following documentation:

• Proof of payment of the corresponding fees.
• Three recent color photographs.
• The filled-in application form EX-17 of the TIE (Foreigner Identity Card).
