How can you apply for the social arraigo without a job offer? That’s the subject of today’s post.

If you have been residing in Spain irregularly for some time and want to regularize your legal situation, the Social Arraigo can be an ideal option to request your residence permit and be able to work legally. However, generally one of the main requirements is to have a job offer. Therefore, the subject of today’s post arises:

Can you apply for the Social Arraigo without a Job Contract?

Yes, it is entirely possible to apply for the Social Arraigo successfully without having to have a job offer. There are two ways to do this:  

  • Starting your own economic activity on your own.
  • Proving sufficient financial means to live in Spain. It should be added that this money income can be yours or from a family member you live with.

1. Starting your own business

In this case, you can request the Social Arraigo when you start your own business, registering as a self-employed (autónomo) or as an independent professional.

The requirements are exactly the same as in the case of applying for the Social Arraigo in Spain in general. However, in this case, it will be necessary to justify and define by means of a business plan the activity that you will develop in which you explain its structure and its financial projection.

On the other hand, it will be completely valid and necessary to demonstrate to the immigration authorities that you have the educational level, training, and knowledge to develop the chosen economic activity effectively.

2. Proving your own economic means

In this case, it will not be necessary to provide an employment contract or start your own activity, since you have the economic means to live on your own (savings in a bank account) or, failing that, depend on a family member with sufficient income to live (in which case you should provide a marriage certificate or registration of domestic partnership).

In the aforementioned cases, the financial means must be provided when applying for the Social Integration Report, which will serve as proof that it will not be necessary to provide a job offer during your application at the immigration office.

Regarding your income, an amount similar to that of the family reunification in all the immigration offices is mentioned as 100% of the Minimum Vital Income.

Note: You must take into account that under this option, you will not be able to work in the country, because you do not have the required permit.

General Requirements of the Social Arraigo in Spain

Although there is no need to provide a signed job offer, there are still requirements for the Social Arraigo in Spain that must be fulfilled at the time of the application:

  • Demonstrate your integration with Spanish culture and society, either through a personal interview or demonstrating the link with a Spanish family member.
  • Demonstrate that you have been in Spain for 3 years continuously
  • Demonstrate that you have a clear criminal record. This is only in cases where you have been continuously in Spain for 5 years or have submitted another residence application.
