How to unsubscribe at the same time in the Treasury and Social Security?
By electronically sending the DUE, the system begins the process by transferring to each organization the documentation that corresponds to each one for the cancellation. In the first place, the General Treasury of Social Security will communicate the cessation of activity and will generate the cancellation of the self-employed person in the contribution account and in the Special Regime for Self-Employed Workers (RETA in Spanish).
Secondly, the Town Halls that collaborate with CIRCE or are adhered to the Emprende en 3 program, will make the request for the cessation of the worker’s activity. Thus, the DUE will request the deregister from the Census of Entrepreneurs, Professionals, and Retainers before the Tax Agency.
It is worth noting the following: through CIRCE it is not possible to process terminations of work contracts electronically, nor the communication of the closure of the Work Center, in case of having contracted workers.
Nor can you unsubscribe from the personal files at the Spanish Agency for Data Protection via the Internet.
Fill in the DUE
To process the DUE to deregister as a self-employed person, it is necessary to provide the original and a photocopy of the DNI of the self-employed person and, if applicable, of the workers. Also, the original and a copy of the Social Security card or any other document that proves the affiliation number is needed.
And if the self-employed person is married, they must also present the ID of the spouse and declare the matrimonial regime in which they are; Likewise, they will be asked for the information of the company’s address, the Social Security contribution account number, if the self-employed person is a foreigner, they must provide the NIE and the residence and self-employment permit.
Deregister as a Self-Employed: as important as signing up
When a self-employed person registers, they become visible to the Treasury and Social Security at the same time. It is a mandatory procedure for you to legally undertake your own professional activities.
What activities are they? Taxing the Treasury is one of the first and most important, to be able to declare some type of tax such as VAT or IRPF and be up to date with tax withholdings. The Tax Agency is aware of these operations and they are only possible if the self-employed person is registered in at least one heading of the IAE (Economic Activities Tax).
It is similar with Social Security: registration in the Special Regime for Self-Employed Workers (RETA) is required and a monthly fee must be paid so that the self-employed person can access various coverages such as common contingencies, unemployment, or professional training.
What happens when a freelancer is not registered?
If a self-employed person is not contributing to Social Security or declaring taxes to the Tax Agency, it means that he cannot work, be able to issue or receive invoices, or enjoy social protection.
