“Darse de baja” refers to the process by which a self-employed person, i.e., an autónomo, decides to cease their activity and formalizes this cessation with the relevant authorities. In many countries, this involves several administrative and legal steps. Here is what this usually entails:

  1. Cessation of activity: The autónomo stops performing the economic activity they had been carrying out.
  2. Notification to Social Security: It is necessary to inform Social Security so that they stop charging monthly contributions.
  3. Notification to the Tax Authorities: The autónomo worker must notify the Tax Agency (AEAT) of the cessation of their activity, which involves filling out certain forms.
  4. Settlement of outstanding taxes: They must ensure that all taxes and tax obligations are in order, including the payment of VAT and income tax up to the date of cessation.
  5. Closing of accounts: It is necessary to close the accounting books properly, ensuring that all transactions are recorded and that there are no discrepancies.

As with many procedures affecting self-employed workers, specific requirements must be met to deregister as autónomo. The main requirements are detailed below:

Tax Agency (Agencia Tributaria – AEAT)

To deregister with the Tax Agency, you must file Form 036 or its simplified version, Form 037.

  • When submitting the request, make sure to deregister from all IAE activity categories in which you are currently registered.

  • The process can be completed online with a digital certificate; otherwise, you’ll need to visit a Tax Agency office in person.

Social Security (Seguridad Social)

Just as when you registered, you must also formally deregister from Social Security. The process is generally quick and straightforward.

If done in person, waiting times at the offices can be long due to high demand, so having a digital certificate is highly recommended, as it allows you to complete the procedure entirely online without leaving home.

What are the deadlines for deregistering as an autónomo?

The deadlines for deregistering as a self-employed worker vary between the Tax Agency and Social Security, and it is crucial to be aware of them to avoid possible penalties in the form of additional fees.

To request deregistration with the Tax Agency, you have one month before the cessation or dissolution of the activity. This margin is wide, but it contrasts with the deadline set by Social Security.

Social Security requires you to notify them of your deregistration within 3 calendar days of the effective cessation of activity. However, due to recent legislative changes, it is now possible to notify them of your deregistration up to 60 days before the cessation.

In addition, it is important to note that you can request deregistration on the date corresponding to the cessation of activity up to 3 times a year. If you exceed this limit, additional deregistrations will be transferred to the last day of the month in which the cessation takes place, which requires payment of the full monthly fee.

If you have followed all the steps indicated, you should now be deregistered as a self-employed worker. To confirm your status, go to the Social Security website and follow these steps:

  • Go to the Electronic Office.
  • Click on “Citizens.”
  • Select “Reports and Certificates.”
  • Go to “Current worker status report.”

In this report, you can verify whether you have indeed left the special regime for self-employed workers.

Canceling your registration as an autónomo does not mean that your tax obligations have ended. You must submit the outstanding quarterly forms corresponding to your activity.

For example, if you cancel your registration in February, you must account for VAT and income tax, if applicable, from January to the date of cancellation in February. In April, you must submit the corresponding forms with the amounts invoiced during that period.

Likewise, at the end of the year, you must file the annual forms required for all self-employed workers. These forms will reflect the amounts invoiced from January to the date of deregistration in February. This is mandatory, and by completing this final annual filing, you will have fulfilled all your tax obligations.

Failure to comply with these filings may result in the usual penalties for self-employed workers who receive notices from the tax authorities or file their forms after the deadline.
