What is the Residence As An Employee?
The residence as an employee in Spain, is an authorization that allows foreigners to live and work in Spain while they are employed by a company or entity in the country.
In order to obtain the residence as an employee permit, generally the employer is required to submit a valid job offer and meet the legal requirements for hiring a foreigner. Once the employer has submitted the job offer and met the requirements, the foreign employee can apply for the residence as an employee.

Legal residence in Spain
This permit grants legal residence to beneficiaries and their families, providing stability and allowing them to live legally in the country. In addition, social and health services can be accessed.
Possibility to work legally
The holders of the residence as an employee permit have the right to work in Spain under the same conditions as Spanish citizens.
Mobility within the Schengen Area:
It allows unrestricted mobility within the Schengen Area, allowing you to enjoy visiting other member countries without the need for visas or border controls.
Conditions for the Employee
- NOT being a citizen of the European Union.
- Application form Form EX03, filled out and signed.
- Criminal records certificate of the country or countries in which the applicant was resident in the last 5 years.
- Evidence of payment of the temporary residence fee for exceptional circumstances (Form 790-052).
- Evidence of payment of the fee paid by the employer (Form 790-062). The value depends on the province.
- Permit requested to the national employment situation (Your hiring contract will be evaluated).
- Full copy of valid passport or travel document (valid for at least four months).
- All documents must be legalized and/or apostilled and translated into Spanish or the co-official language of the territory where the application is submitted.
Conditions for the employer
Individual entrepreneur:
They must attach a copy of your NIF or NIE, or consent to verify their identification data through the Identity and Residence Data Verification System.
For domestic service:
- Copy of the employer's NIF or NIE or consent to verify the identification data through the Identity and Residence Data Verification System.
- They must submit the original and a copy of the employment contract. The copy will be stamped by the Immigration Office and returned for subsequent presentation by the foreigner together with the application for the residence and work visa.
- Copy of the last income tax return or certification of income issued by the Tax Agency or other documentation that certifies sufficient solvency for the contract.
Legal person:
- Copy of the NIF of the company and copy of the deed of incorporation properly registered in the corresponding Registry.
- Copy of the public document certifying that the signer of the authorization application is the company's legal representative.
- Copy of the NIF or NIE or consent to verify the identification data through the Identity and Residence Data Verification System of the signer of the application.
- Accreditation that the company can guarantee the necessary solvency (ex: Copy of the IRPF, or VAT, or Corporate Tax return, or of the company's work life report (VILE), referring to the last three years).
