Conditions for applying for Spanish nationality by residence

Continuing Residency:

You must have lived in Spain continuously for 5 to 10 years. The period varies depending on your personal situation, such as if you are a citizen of an Ibero-American country or from other nationalities. Consult all the cases here.

Good Conduct:

During your time of residence in Spain, you must have maintained exemplary conduct, complying with the laws and regulations of the country.

Knowledge of Language and Culture:

In some cases, it may be necessary to demonstrate your knowledge of the Spanish language and culture as part of your integration into society.

Born in Spanish territory

Birth certificate of the interested individual issued by the Spanish Civil Registry, not older than 3 months.

Those who have not exercised the right to apply for their nationality in due time

Documentation that certify having been included in one of the cases of Article 20.1 of the Civil Code: Literal birth certificate of the Spanish father/mother; birth certificate of the interested individual registered in a Spanish Civil Registry or judicial resolution stating the adoption of the interested individual.

Persons under tutorship, guardianship or non-provisional sheltering

In cases of provisional sheltering: competent Auto del Tribunal will be designating the person who is to exercise the tutorship, guardianship or provisional sheltering.

In cases of foster care by a Spanish institution: Resolution of said institution by which the tutorship, guardianship or provisional sheltering is assumed.

Refugees and stateless persons

The documentation issued by the Ministerio del Interior proving this status can replace the birth certificate and the criminal record certificate of the country of origin, and even the passport.

Married to a Spaniard

In these cases you must include the following document:

  • Birth certificate of the Spanish spouse, issued by the Spanish Civil Registry, not older than 3 months.
  • Marriage certificate issued by a Spanish Civil Registry, not older than 3 months.
  • Certificate of cohabitation or historical empadronamiento with the spouse for the last year.
  • Copy of the spouse's DNI on both sides.

Widow/er of a Spanish citizen

  • Birth certificate of the Spanish spouse, issued by the Spanish civil registry office.
  • Marriage certificate issued by a Spanish Civil Registry, not older than 3 months.
  • Certificate of cohabitation or historical empadronamiento (at the date of death of the spouse).
  • Spouse's death certificate.
  • Spanish descendant

    In these cases you must add the following document:

    • Literal birth certificate of the Spanish spouse, issued by the Spanish Civil Registry.

    Please don't trust this company. They have made a big mistake with my taxes and I have lost the right to a flat rate which means I will be charged 3 x as much per month for being autonomo as I should be. Haven't responded at all to my complaint, no apology no justification nothing. Please use a legit Spanish company like Vilar & associates who are not trying to resolve this issue for me. Don't waste your money. *update* I have just found just found out I am in debt of over 3000 euros to the government because of this company's incompetence. I have contacted them with my complain but of course no response. Having just had a baby and on maternity leave until recently, now finding out I owe this and I paid this company to sort these issues for me but they have well and truly dropped me in the ***. will be taking legal action.

    Mala la atención. Pague por una consulta de 1 hora con una abogada del equipo la cual me despachó a los 30 minutos. Me hizo seguimiento los días posteriores para que pague el trámite sin darme ningún tipo de pasos a seguir. No los contraten, no dejen sus trámites importantes en este tipo de personas.

    PÉSIMO SERVICIO, TENGAN CUIDADO!!!!!!!!!!!! absténganse de utilizarlo. Poco profesional , los abogados están más interesados en cobrar el servicio más alto así no sea el indicado , ni posible . Ofrecen un 98% de éxito para cerrar la venta y a la hora de la verdad cuando es hora de entregar resultados se desaparecen. MUY POCO PROFESIONALES. Estoy segura que si hacen un poco de research encuentran un lugar mejor, funcionan como un software y no como un bufete de abogados responsables.

    POR FAVOR No los utilicen! Se van a arrepentir y sus procesos migratorios no saldrán bien. Es un muy mal servicio. En mi caso me ofrecieron un servicio que no era acorde an mis necesidades solo porque el valor era superior . Pedí un reembolso y no han sido capaces de reembolsar el dinero. Tampoco completaron el servicio.

    Absolutely horrible. All they had to do was fill out a simple modelo 030, they took FOREVER and messed up 3 times and now the person is in a worse place than where he started. This is so shameful. AVOID!

    General Info

    Depending on the person’s case, status and nationality, you usually have to reside for 1 to 10 years in Spain to obtain the nationality

    To know about the status of your nationality application in Spain, you can follow these steps:

    1. Access the Administration Portal: Go to the official website of the Ministerio de Justicia de España (https://sede.mjusticia.gob.es). This is the website where you can carry out different formalities related to legal procedures, including Spanish nationality by residence.

    2. Identify yourself: If you already have an account on the portal, log in with your credentials. If don’t, you will need to create an account.

    3. Access the Nationality Section: Once in your account, look for the section related to the processing of nationality by residence applications. Generally, you will find this section in the “Extranjería” or “Nacionalidad” category.

    4. Check File Status: Within the relevant section, you should be able to find an option to check the status of your file. You may be asked to enter your file number or other identifying information.

    5. Check Status: Once you enter the required information, the system will provide you with an update on the status of your application. This could include whether it is in process, if further documents are required, if it has been approved or any other relevant information about it.

    6. Updates and Notifications: In some cases, you will receive email notifications or messages in your portal account whenever there is a significant change in the status of your application. This will depend on how the system is configured and the notification policies of the Ministerio de Justicia.

    In general situations, the foreigner is required to have lived in Spain continuously for at least 10 years before applying for residence. However, there are exceptions that can significantly shorten this period:

    • 5 years: for recognised refugees.
    • 2 years: for citizens of Latin American countries, Andorra, the Philippines, Equatorial Guinea, Portugal, or of Sephardic origin.
    • 1 year: for individuals who meet specific conditions, such as being born in Spanish territory, having been under guardianship or legal provisional sheltering of Spanish citizens, being married to a Spanish citizen for at least one year, being the widow/widower of a Spaniard, or having Spanish ancestry of certain degrees.

    Knowing how long it takes to obtain Spanish nationality is a complicated process because it depends on the case. But, in general, the resolution of the application takes around 2 to 3 years in total.
