Can I apply for the Family Arraigo?
In Spain, the family arraigo (“arraigo familiar” in Spanish) is a residence permit granted to foreigners who can prove that they have family ties with Spanish citizens or legal residents in the country.
In order to apply for the family arraigo, it is essential to justify the existence of these family ties and to fulfill one of the following conditions:
- Father/mother/guardian of a minor of Spanish nationality. Must be in charge of the minor and/or fulfill his or her parental obligations.
- Father/mother/guardian of an EU minor (only if they do not have sufficient financial means to apply for an EU Family Member Card).
- Ascendant over 65 years of age or under 65 years of age dependent on the Spanish citizen or legal resident in Spain.
- Spouse or domestic partner ("pareja de hecho") of a Spanish citizen. The union must be valid and legally registered
- Descendants under 21 years of age, or dependents over 21 years of age, of a Spanish citizen, or of their spouse or domestic partner.
- Child of an original Spanish citizen.
- Dependent of a Spanish citizen with a disability, provided that both live together.

This permit grants legal residence to beneficiaries and their families, providing stability and allowing them to live legally in the country. In addition, social and health services can be accessed.
Possibility to work legally
Holders of this authorization have the right to work in Spain under the same conditions as Spanish citizens.
Mobility within the Schengen Area
It allows unrestricted mobility within the Schengen Area, allowing you to enjoy the convenience of visiting other member countries without the need for visas or border controls.
Requirements and necessary documentation
- NOT to be a citizen of the European Union.
- Application Form EX10, filled out and signed.
- Criminal record certificate from the country or countries in which you were resident in the last 5 years.
- Proof of payment of the fee for temporary residence for exceptional circumstances (Form 790-052).
- Full copy of valid passport or travel document (valid for at least four months).
- All documents must be legalized and/or apostilled and translated into Spanish or the co-official language of the territory where the application is submitted.

Documentation accrediting the family relationship and nationality:
Father/mother/legal guardian of a minor of Spanish nationality: Birth certificate of the minor of Spanish nationality.
Child of a Spanish father or mother: Birth certificate of the applicant and birth certificate of the Spanish father or mother or certificate from the Civil Registry accrediting this status.
Marriage or domestic partnership: Documents proving the link with the Spanish citizen, such as joint empadronamiento, shared bills, official registration of the union, Spanish citizen's ID card, children in common, etc.
