Form EX01 includes the following types of permits:
- Holder of a previous residence permit that ends in such condition.
- Voluntarily returned foreigner (art. 120)
- Relative of the holder, or the applicant in the process of residence and work permit for activities of special interest (DGI-art. 181)
- Minor born in Spain son of a resident (arts. 185.1 and 2)
- Minor not born in Spain, son of a resident or ward (arts. 186)
- Unaccompanied foreign minor under guardianship, custody, provisional protection, or custody by a Public Entity for minors (art. 196)
- Holders of a residence and work permit for researchers, residence and work as an employee (“cuenta ajena”), or residence and work as a self-employed (“cuenta propia”) that cease in such condition (art. 203)
- Nationals and their relatives under International Agreements.
- According to Instructions of the Council of Ministers (DA 1ª 4)
- Holder of a stay permit for higher education studies that ceases, for job search (DA 17th Law 14/2013)
- Family members of the holders of a stay permit for studies that ceases to be in such condition (DA 17th Law 14/2013)
What is Form EX01 for?
Form EX01 is used to request temporary residence in Spanish territory, which will initially have a duration of one year. It must be taken into account that this permit will be only for purposes of residence and it does not allow the foreigner to work. It is also known as the Non-Lucrative Visa.
Who can request it?
It must be requested directly by the foreigner who wants to reside in Spain.
What are the required documents besides Form EX01?
In the first place, the corresponding visa must be requested, in person, at the Spanish diplomatic or consular demarcation of your residence area. Once the visa application has been submitted, it must be attached along with the application for the Non-Lucrative Temporary Residence Permit, and the following documents must also be provided:
- Passport or travel title with a minimum validity of one year.
- Criminal record certificate issued by the authorities of the country of origin or of the countries of residence during the last 5 years.
- Documentation proving that you have sufficient financial means to reside in Spain without working.
- Documentation proving the coverage of medical insurance, public or private.
- A medical certificate, stating that you do not have any of the diseases that may have serious public health repercussions.
- Paid visa issuance fees and residence permit fees, which is Fee 790 Code 052.
Where to submit Form EX01?
The place of submission of the application will be the Spanish diplomatic mission or Consular Office in whose demarcation the foreigner resides.
What is the period to obtain a resolution?
The term of resolution is three months from the day following the date on which it was received at the registry of the competent body for its processing.
