What is the Arraigo Laboral in Spain?
The Arraigo Laboral is a temporary residence authorization for exceptional circumstances designed for foreign individuals who have stayed in Spain irregularly, for a minimum period of 2 years.
This administrative migration process provides the opportunity for those without the relevant documentation, who have been living in Spanish territory for a period of 24 months, to normalize their status and get a legal residence licence.
On the other hand, the Arraigo Laboral diferent from the other types of Arraigo because it has a particular characteristic that makes it someway complex. In order to applicate for the Arraigo Laboral procedure, the foreign applicant must validate an employment relationship of at least 6 months. This implies that, during the 2 years in which they were in Spain in an irregular situation, they must have been employed for a minimum of 183 day

Conditions and documents to request the Arraigo Laboral in Spain
- Not being a citizen of the European Union.
- Have no criminal record in Spain or in their previous countries of residence.
- Not being banned from coming to Spain.
- Not being, if necessary, within the period of commitment of not returning to Spain.
- Having stayed continuously in Spain for a minimum period of two years. Sustained residence is understood to be if the absences have not exceeded 90 days in the last two years.
- All documents must be authenticated and/or stamped with an apostille, and translated to spanish or co-official language of the territory where the application is submitted.
- Printed Form EX10, filled out and signed.
- Criminal record certificate from the country or countries in which the applicant was resident in the last 5 years.
- Passport, travel document or identity card valid for at least four months.
- Documentation supporting the continued stay in Spain for a minimum period of three years: The documentation provided must contain the applicant's identification information, ideally issued and/or registered by a Spanish Public Administration. For example: Empadronamiento, documentation relating to a hospitalisation/medical consultation or any municipal, regional or state documentation that justifies their presence in Spain.
- Documentation supporting the existence of labour relationships, which may be: a judicial resolution, a judicial conciliation report which recognises it, or the administrative resolution confirming the infraction report of the Labour and Social Security Inspection which certifies it.
