What is the Grandchildren Law (Ley de Nietos)?
The Grandchildren Law or Law of Democratic Memory has been officially approved in the Congress of Deputies.
This new law allows children and grandchildren of Spaniards to obtain Spanish nationality directly (without having to reside in Spain for any specific period of time).
Notice: The Grandchildren’s Law is no longer accepting new applications
The Spanish Government has officially confirmed that the deadline to apply for Spanish nationality under the Democratic Memory Law (also known as the Grandchildren’s Law) ended on October 22, 2025, with no further extensions.
As of that date, new applications can no longer be submitted under this law.
However, if you started your process or registered your application before the deadline, your file will continue to be processed by the corresponding Consulate or Civil Registry.
Although this route is now closed, there are still other legal options to obtain Spanish nationality, such as nationality by residence or nationality by option.

Who can apply to the Grandchildren Law in Spain?
Children and grandchildren of Spaniards
Persons born outside Spain, whose parents, grandparents or grandmothers were originally Spanish, and who, due to having experienced exile for political, ideological, religious or sexual orientation and identity reasons, have had their status as Spanish citizens affected either by voluntary loss or renunciation of nationality.
Spaniards who lost their nationality by marrying foreigners
Sons and daughters born abroad of Spanish women who lost their nationality because they married foreigners before the 1978 Constitution came into force in 1978.
Children of legal age
The sons and daughters of legal age of those Spaniards whose nationality of origin was recognized by virtue of the right of option in accordance with the provisions of this Law or in the seventh additional provision of Law 52/2007, of December 26th.
Documentation required for the Grandchildren Law application

The applicant must provide the following documents:
to prove the relationship:
1. Identity document.
2. Literal birth certificate of the applicant.
3. Birth certificate of the applicant's ancestor (father, mother, grandfather or grandmother) who was originally Spanish.
4. In the case of applying for the Grandchildren Law by a grandparent, it will also be necessary to provide the literal birth certificate of the father or mother who corresponds to the family line of the original Spaniard. -
If the process of obtaining nationality relates to a family member who was exiled, the following additional documentation is required:
1. Documentation certifying that you have been a beneficiary of pensions granted by the Spanish Administration.
2. Documentation from the United Nations International Refugee Office (Oficina Internacional de Refugiados de Naciones Unidas) and from the Refugee Offices of the host States (Oficinas de Refugiados de los Estados de acogida).
3. Certifications or reports issued by political parties, syndicates or any other entity or institution (whether public or private), recognised by the Spanish authorities or the authorities of the exiles' host State, which are related to the exile.

General Info
In such cases, the baptismal certificate from the parish or diocesan archives may be attached, together with the negative certificate of birth registration issued by the corresponding registry office.
You can begin the process either in Spain or in your country of origin, so it is not necessary to travel to Spain to apply for the Grandchildren Law. Although, in both cases you will present all the documentation either at the Civil Registry located in Spain or at the consular Civil Registry in your country of origin.
The Grandchildren Law has a term of 2 years for its application, which could be extended for 1 more year. This period started on October 21, 2022.
You will be able to access the following:

- Disability and non-contributory retirement.
- Birth and schooling.
- Health coverage.
