Application for a Temporary Residence or Stay Permit Exempt from a Work Permit

Official Spanish government form used by non-EU citizens to apply for a residence or stay permit when their specific professional activities (e.g., researchers, artists, or religious ministers) legally exempt them from requiring a standard work permit.

Officially known in Spanish as: “Solicitud de autorización de estancia o residencia temporal con excepción de la autorización de trabajo”.

Through Form EX09, a permit to stay or reside temporarily in Spain is requested. However, the foreigner who is going to carry out a certain lucrative or professional activity for a period of more than ninety days is not obliged to request a work permit if they meet certain conditions we will mention below.

Form EX09 includes the following types of permits:

  • General case of residents outside Spain for exempted activities of more than 90 days (art. 117).
  • Minors of working age under the guardianship of a welfare entity (art. 117.j).
  • Holder of a residence permit for study, research or internship that ends in such condition (art. 199).
  • Holder of a previous residence, or residence and work authorization that ends in such condition (art. 200-203).

What is it for?

It is used to request a temporary residence or stay permit, with the exception of a work permit in cases where the applicant is:

  • Technicians, researchers and scientists, invited or contracted by the General State Administration, autonomous communities, universities, etc.
  • Professors, technicians, researchers and scientists invited or contracted by a Spanish university.
  • Management or teaching staff of cultural or educational institutions dependent on other States, or private of accredited prestige.
  • Civil or military officials of foreign state administrations.
  • Foreign media correspondents.
  • Members of international scientific missions carrying out work and research in Spain.
  • Artists who come to Spain to carry out specific performances that do not involve a continuous activity.
  • Religious ministers and members of religious hierarchy.
  • Foreigners who are members of the representative, governing and administrative bodies of trade unions and internationally recognized business organizations.
  • Foreign minors of working age under the guardianship of a competent child protection service.

Who can request it?

The foreigner must request it personally.

What are the required documents, in addition to Form EX09?

The documents that must be attached together with the application form are:

  • A complete copy of the passport, travel title, or registration document with a minimum validity of 4 months.
  • Documentation proving the case of exception to the work permit.
  • If you are not a resident of Spain, you will have to provide a criminal record certificate and medical certificate.

Where should the application be submitted?

In the event that the applicant is a resident of Spain, they may present it at the Immigration Office of the province where the work center is located or where the service will be provided. If the applicant is not a resident of Spain, they will have to present it at the Spanish Diplomatic Mission or Consular Office of their area of ​​residence.
