Requirements and documentation for divorce by mutual consent
- Minimum time of marriage: At least 3 months must have elapsed since the celebration of the marriage.
- Will of at least one of the spouses: The consent of both spouses is not necessary to initiate the process.
- Residence in Spain: At least one of the spouses must reside in Spanish territory.
- Literal marriage certificate (obtained at the Civil Registry Office).
- Certificate of registration of the spouses.
- Identity documents (DNI, NIE or passport) of both spouses.
- Mandatory legal advice: Although not always formally regulated, the intervention of a lawyer and, in legal proceedings, also of a prosecutor is necessary to ensure the validity of the agreement.
- Settlement agreement: This is the document in which the agreements on custody, pensions, visitation, use of the family home and liquidation of assets are included.
- Certificates related to the children: If applicable, it is necessary to present the birth certificate of the children, in order to include them in the regulatory agreement.
