Application for maternity / paternity leave in Spain

What is it?
Maternity leave is a labor right that gives working women the necessary time to recover physically and emotionally after childbirth, as well as to care for and attend to their newborn or newly adopted child. During this period, the mother may be temporarily absent from work, receiving a 100% pension, which is financed by Social Security.
Requirements for maternity and paternity leave:
- The self-employed worker must be registered with the Social Security and be up to date with her Social Security contributions at the time of requesting maternity leave.
- You must have paid Social Security contributions for a minimum period of time, depending on your age.
- There may also be other requirements, such as being registered as self-employed in the Special Regime for Self-Employed Workers (RETA). Once the requirements have been met, the self-employed worker can apply for maternity leave.

General Info
Social Security in Spain is a social protection system that provides a series of benefits and services designed to protect citizens in situations of need and self-employed workers or employees must register.
How are payments calculated?
As a self-employed person in Spain, the contributions you must pay to Social Security vary according to different factors, such as your income and the contribution base you choose.
You should apply for maternity leave well in advance of the expected date of delivery. It is recommended that you apply approximately 15 days before the estimated date of delivery.
This allows Social Security or your employer to process the application and make the necessary arrangements smoothly.
The length of maternity leave in Spain varies according to current legislation and can be between 16 and 26 weeks.
In addition, there are mandatory and optional periods within this duration, depending on your particular situation and whether you decide to share the leave period with the other parent.
During maternity leave, the employee will be entitled to receive 100% of the regulatory base established for the temporary disability benefit for common contingencies.
In case you need to extend the maternity leave for medical or personal reasons, it may be necessary to file a request for an extension with the competent entity.
What is required for an extension?
- Assess whether you need to extend your maternity leave.
- Consult with your doctor and obtain a medical report if necessary.
- Inform your employer of your intention to request the extension.
- Gather the necessary documentation, including the medical report.
- Complete the application forms and submit them within the established deadlines.
- Follow up with your employer or Social Security for updates on the status of your application.
Process
The documents required may vary depending on your particular situation, but generally you will need to complete and sign the maternity leave application form, submit a medical report if necessary, provide a copy of your identity card, family book or baby’s birth certificate, and possibly your employment contract.
