Declaration of Holders of Spanish Investments Abroad in Negotiable Securities
Form D6 is an annual informative declaration of Spanish investments abroad in companies that trade on a stock exchange or organized market. In other words, when the values are deposited in an entity located abroad or remain under the custody of the holder of the investment. It came into force by the end of 2021.
This form is for information purposes only, mainly to allow the Ministry of Industry, Commerce and Tourism to have a record of all investments of Spanish residents deposited or held abroad. It is not subject to payment of any additional tax. Form D6 does not replace the Tax Agency’s Form 720, it is complementary to it.
Notice: Form D6 has been repealed
The Spanish government decided in December 2021 to eliminate the obligation to present Form D6 for most investors. This legislative change was introduced in the Order ICT/1408/2021, dated December 14th.
From that moment on, only investors who hold a participation equal to or greater than 10% of the capital or voting rights of the company in which the investment is held, will be required to submit the D6 form.

When is it filed?
Form D6 must be filed before January 31st of each year.
Where is it presented?
At the Registry of Spanish Investments Abroad, which depends on the Ministry of Economy. By telematic means or by certified mail.
Who must file it?
Residents in Spain with investments abroad through brokers outside the country. If you have less than 10% in shares or use Spanish brokers, it is not mandatory to file it.

How to fill out Form D6?
Here is the step-by-step process on how to fill out and present the Modelo D6 in Spain.
Prepare the information:
Before you start, make sure you have all the necessary information about your investments. This data can be obtained from your broker.
Download and install the Aforix program:
This program is required to fill out the Modelo D6. You can download it from the electronic headquarters of the Secretary of State for Commerce. You can login using the electronic DNI or digital certificate.
Complete the form:
Open the Aforix program, create a new form of type D6 and fill out the corresponding fields. This includes personal data, details of the investment, such as the name of the foreign company and the amount of shares held, as well as any other details required by the declaration. Be sure to indicate whether it is a deposit or flow statement.
Presentation of Form D6:
Once you have completed the form, you must submit it, either online or by certified mail. Remember that the deadline for submitting the form is January 31st of each year.
