What Is Your Starting Point?
For UK citizens, the process depends on whether you were already a resident in Spain before December 31, 2020.
CASE A: You were already a resident in Spain before the end of 2020.
Gather Your Documents:
- Official application form (Form EX-23): Correctly filled out and signed.
- Valid Passport: A complete copy.
- Your current TIE card proving your residency under the Withdrawal Agreement.
- Proof of continuous residence: An empadronamiento histórico certificate showing 5 years of registration.
- Proof of payment of the fee: Form 790, code 012.
Submit Your Application:
- In-person: At the Foreigners’ Office (Oficina de Extranjería) in your province or the relevant Police Station (prior appointment required).
- Online: With a digital certificate via the Mercurio platform.
Get Your New TIE Card:
- Once your application is approved, you must apply for your new TIE card, which will state “Residente Permanente” (Permanent Resident). This involves booking another appointment for fingerprinting.
CASE B: You want to become a resident after Brexit.
If you moved to Spain on or after January 31, 2020, you are not covered by the Withdrawal Agreement. You fall under the general immigration regime, just like citizens from other non-EU countries.
- First, you need an initial residence permit: This involves applying for a visa at the Spanish Consulate in the UK.
- After 5 years of continuous legal residence with your temporary residence permits, you can then apply for Long-Term Residence.
The process is similar, but the application form is EX-11, and you must provide documentation proving 5 years of legal residence with your previous temporary permits. Proving sufficient financial means and healthcare coverage throughout the period is crucial.

Is my old green "EU residence certificate" still valid?
While the green certificate still legally proves your residence, it is highly recommended to exchange it for the new TIE card under the Withdrawal Agreement. The TIE is a more robust, biometric photo ID that simplifies all administrative processes.
What are the "permitted absences" to maintain continuous residence?
To not break the 5-year continuity, your absences from Spain should not exceed 6 months per year, or a total of 10 months within the 5-year period (with exceptions for specific reasons like work assignments or serious illness). The rules for Withdrawal Agreement beneficiaries are generally more flexible.
Can I lose my long-term residence?
Yes. It can be terminated by an absence from Spain of more than 2 consecutive years, or by an absence from EU territory for 12 consecutive months if you hold the Long-Term EU version.
Do I have access to the NHS if I am a resident in Spain?
If you are a UK state pensioner, you can get access to Spanish healthcare funded by the UK via an S1 form. If you are a worker, you will contribute to the Spanish social security system, which grants you access to public healthcare.
