Non-resident companies in Spain and their registration
When a foreign worker arrives in Spain, they must regularize their status in order to work legally. There are two main ways to do this:
- It involves creating a Spanish company from scratch.
- This is the usual route if the foreigner obtains a self-employed visa.
- It requires notarization, opening a bank account, share capital, and a process that can take between 6 and 8 months.
- The existing foreign company obtains a tax identification number in Spain.
- The "Código de Cuenta de Cotización" (CCC) is created with Social Security.
- The entrepreneur or administrator may be hired as an employee by that foreign company registered.
- It is the fastest and most practical option for those who have a work visa as an employee or a digital nomad visa.
Basic obligations of a non-resident company in Spain
Once registered, the company must meet certain minimum requirements:
Social Security
The company must have a "Código de Cuenta de Cotización" (CCC) in order to register its workers and pay monthly Social Security contributions, guaranteeing rights such as medical care, retirement, or unemployment benefits.
Modelo 111
This is the quarterly declaration of income tax withholdings on the employee's payroll. It is supplemented by the annual Form 190, which summarizes all withholdings submitted during the year.
Basic tax compliance
Even if the company does not operate commercially in Spain, it must keep up to date with these obligations. It is only liable for corporate income tax if it has a permanent establishment in the country.
What taxes does a non-resident company in Spain pay?
Non-resident companies are taxed only on income earned in Spain. Their main tax obligations are:
- Modelo 111: Quarterly declaration of income tax withholdings from employees.
- Modelo 190: Annual summary of withholdings.
- Social Security contributions: Payment of contributions corresponding to the registered worker.
In general, a non-resident company is not subject to corporate income tax in Spain (unless it has a permanent establishment in the country), which simplifies its obligations compared to a resident company.

What is a non-resident company in Spain?
A non-resident company in Spain is one whose headquarters and main activity are located in another country, but which needs to register in Spain to comply with tax or labor obligations.
It is not considered a Spanish company, but it obtains a Tax Identification Number (NIF) that allows it to operate in a limited capacity, primarily to hire workers or fulfill tax obligations.
What are the differences between a resident and a non-resident company?
Company resident in Spain: a company incorporated under Spanish law, with its tax domicile in the country. It must pay corporate income tax on all its worldwide income and comply with all local commercial obligations.
Non-resident company in Spain: a company incorporated abroad, but which can register in Spain with a Tax Identification Number (NIF) and a Contribution Account Code (CCC) to comply with specific obligations, such as hiring employees. What does it mean to obtain a "Código de Cuenta de Cotización" (CCC) with Social Security?
The CCC is the number assigned by Social Security to the company in order to register workers and manage their contributions.
Even if the company does not have commercial activity in Spain, it needs this code to pay Social Security contributions for registered employees, thus guaranteeing their labor rights.
