What steps do I need to take to set up a law firm in Spain?
Here is the step by step process of everything you need to do to set up your law firm in Spain:
Education and Certification
Make sure you have the necessary training and certification required for lawyers in Spain to work succesfully.
Solicita un permiso de trabajo ya sea desde tu país de residencia o desde España (con visado de turista). Puede tratarse de un visado para trabajar por cuenta propia o como trabajador altamente cualificado.
Legal and Tax Compliance
Register your law firm in Spain with the corresponding Bar Association, comply with tax obligations, obtain an NIF and make sure you meet legal and ethical regulations.
Legal Structure
Select the legal structure of your law firm in Spain, whether it is an individual, sole proprietorship or a law partnership, and register it if necessary.
Resources and Marketing
Obtain an establishment and the necessary resources, and develop a marketing strategy to attract clients to your law firm in Spain. Also, consider protection through professional liability insurance.
Additional information to be taken into account:
- Be clear about your fees and payment terms with the clients. Establish a legal services contract that describes the services to be provided, the associated costs and mutual expectations.
- If you have staff in your law firm in Spain, you must be a good employer. This includes hiring qualified workers, establishing appropriate employment contracts, and managing effective labor relations.
- Make sure you are in compliance with the data protection regulations in force, such as the General Data Protection Regulation (GDPR) in the European Union, to ensure the privacy of your clients' information.
- Consider planning for succession if you consider a retirement in the future. This involves determining how the law practice will be transferred to other attorneys or partners.
What procedures do I have to file depending on the tax nature?

For lawyers in Spain:
- Personal Income Tax (IRPF): You must file a quarterly tax return using Form 130.
-
Value Added Tax (VAT): Forms 303 and 390 are used for the quarterly and annual tax return, respectively.
You must apply the VAT corresponding to your services sold, which may be 21%, 10% or 4% depending on the category.
What procedures are required if I have a law firm in Spain?
- Corporate Tax : You must file it using Form 200.
- Value Added Tax (VAT): As mentioned above, Forms 303 and 390 are used for the quarterly and annual tax returns, applying the corresponding VAT percentage.
- Fees and local taxes: Depending on the law firm's location, municipal fees or local taxes may be paid, such as real estate or business taxes.
