{"id":35870,"date":"2023-11-23T19:31:23","date_gmt":"2023-11-23T18:31:23","guid":{"rendered":"https:\/\/entretramites.com\/en\/?page_id=35870"},"modified":"2023-11-23T19:40:24","modified_gmt":"2023-11-23T18:40:24","slug":"staffing-agreement","status":"publish","type":"page","link":"https:\/\/entretramites.com\/en\/downloadables\/work-contracts\/staffing-agreement","title":{"rendered":"Template for a Staffing Agreement Contract"},"content":{"rendered":"\n<p>The Staffing Agreement Contract is the one that is\u00a0<strong>concluded between a Temporary Employment Company (ETT) and a user company<\/strong>, in order to assign workers from the Temporary Employment Company to the user company, under a series of requirements that dictate the art.\u00a06 of Law 14\/1994.<\/p>\n\n\n\n<p>In accordance with art.&nbsp;15 of the Workers&#8217; Statute, this type of contract between the ETT and the user company&nbsp;<strong>is carried out under precepts and conditions<\/strong>&nbsp;as if the user company was going to enter into a&nbsp;<strong>temporary contract directly with the worker<\/strong>.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-content-justification-center is-layout-flex wp-container-core-buttons-is-layout-a89b3969 wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link has-white-color has-text-color has-background wp-element-button\" href=\"https:\/\/entretramites.com\/en\/download-form\" style=\"background-color:#293c90\">Download Guide<\/a><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Who participates in the Staffing Agreement Contract and how is it formalized?<\/strong><\/h2>\n\n\n\n<p>This contract is a&nbsp;<strong>commercial agreement between two companies<\/strong>, it is formalized between the ETT and the user company meeting the following roles:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>ETT:<\/strong>&nbsp;A Company that makes workers available&nbsp;<strong>to the user company<\/strong>&nbsp;on a temporary basis.<\/li>\n\n\n\n<li><strong>User company:<\/strong>&nbsp;The one that goes to the&nbsp;<strong>ETT to benefit from the transfer of workers<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>During the employment contract, there would be a third party who is&nbsp;<strong>the worker<\/strong>.&nbsp;Here, they will not formalize the contract&nbsp;<strong>directly with the company<\/strong>&nbsp;for which they will work but will do so with the ETT.<\/p>\n\n\n\n<p>The Staffing Agreement Contract\u00a0<strong>is formalized in writing and in an official form<\/strong>. If it is not done in this way, it will be understood that it will be for an indefinite period.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What information should it contain?<\/strong><\/h2>\n\n\n\n<p><strong>The contract for making temporary service workers<\/strong>&nbsp;available&nbsp;must contain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>ETT data:<\/strong>&nbsp;Authorization number, tax identification number, and account codes for Social Security contributions.<\/li>\n\n\n\n<li><strong>User company data:<\/strong>&nbsp;Tax identification number, account codes for Social Security contributions.<\/li>\n\n\n\n<li><strong>Specific causes that justify the hiring<\/strong>, according to the provisions of Art.&nbsp;11 and 15 of the Workers&#8217; Statute.<\/li>\n\n\n\n<li><strong>Contract period.<\/strong><\/li>\n\n\n\n<li><strong>Place or work center<\/strong>&nbsp;where the employee will carry out his activity.<\/li>\n\n\n\n<li>Worker&#8217;s&nbsp;<strong>salary compensation.<\/strong><\/li>\n\n\n\n<li><strong>Contract price<\/strong>.<\/li>\n\n\n\n<li><strong>Position to be occupied<\/strong>&nbsp;by the worker,&nbsp;<strong>activity<\/strong>&nbsp;to be carried out, and&nbsp;<strong>required qualification<\/strong>.<\/li>\n\n\n\n<li><strong>Measures<\/strong>&nbsp;adopted by the company to comply with regulations on&nbsp;<strong>health and safety at work<\/strong>, according to Royal Decree 216\/1999 on minimum health and safety provisions in temporary employment companies.<\/li>\n\n\n\n<li><strong>Information on facilities and equipment of the user company<\/strong>, both common and individual.<\/li>\n\n\n\n<li><strong>Collective agreements of application<\/strong>, if applicable.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>When can a Staffing Agreement Contract be concluded?<\/strong><\/h2>\n\n\n\n<p>This Staffing Agreement Contract can be carried out in the\u00a0<strong>following cases:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For the&nbsp;<strong>development of a work<\/strong>&nbsp;or service of a specific duration.<\/li>\n\n\n\n<li>When&nbsp;<strong>market circumstances require it<\/strong>, for example in case of excess tasks, accumulation of orders, etc.<\/li>\n\n\n\n<li>To&nbsp;<strong>replace workers<\/strong>&nbsp;whose position has been reserved, as long as the identity of the replaced employee and the reasons for the leave are specified.<\/li>\n\n\n\n<li>When a position needs&nbsp;<strong>to be filled temporarily<\/strong>&nbsp;while selection processes are carried out.<\/li>\n\n\n\n<li>For the&nbsp;<strong>celebration of training<\/strong>&nbsp;or internship contracts.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>When can a Staffing Agreement Contract NOT be concluded?<\/strong><\/h2>\n\n\n\n<p>This Staffing Agreement Contract cannot be entered into when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the user company hires temporary agency workers to&nbsp;<strong>replace employees on strike.<\/strong><\/li>\n\n\n\n<li>When it comes to&nbsp;<strong>hiring workers destined to occupy a high-risk position for health or safety<\/strong>.&nbsp;For example, jobs that involve exposure to radiation or high levels of toxicity, carcinogens, or biological agents are dangerous to the worker.<\/li>\n\n\n\n<li>If the company has already&nbsp;<strong>written off the jobs due to unfair dismissal<\/strong>, in the twelve months prior to hiring.<\/li>\n\n\n\n<li>If the contract seeks&nbsp;<strong>to assign workers to other<\/strong>&nbsp;temporary employment companies.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Is the seniority of the workers taken into account?<\/strong><\/h2>\n\n\n\n<p>The jobs performed through hiring by a temporary employment company&nbsp;<strong>count towards the seniority of the worker<\/strong>, just as it would if the contract had been formalized between the company and the employee.<\/p>\n\n\n\n<p>The calculation of seniority must&nbsp;<strong>go back to the date of the first hire<\/strong>, regardless of whether this occurred through ETT or directly with the company.&nbsp;Seniority is computed to calculate&nbsp;<strong>three-year terms, severance pay, internal promotion, unemployment benefits or subsidies, etc.<\/strong><\/p>\n\n\n\n<p><strong>On the other hand, trial periods<\/strong>\u00a0can be set\u00a0when formalizing a Staffing Agreement Contract as long as it is mutually agreed upon between the two parties, within the\u00a0<strong>limits
