Additional to the same conditions initially agreed.<\/p>\n\n\n\n<p>In addition to the <strong>specific limitations<\/strong> for each type of contract, a <strong>general limit<\/strong> is also established to avoid the chaining of <strong>temporary contracts<\/strong>:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Extension of work and service contracts<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Once the work or service has been performed, <strong>if there is no express denunciation<\/strong> and the employee continues to render services, the <strong>contract shall be considered tacitly extended<\/strong> for an indefinite period of time, u<strong>nless there is evidence to the contrary that proves<\/strong> the temporary nature of the services rendered.<\/li>\n\n\n\n<li>In the event that a duration or term is<strong> established<\/strong>, this should be considered as a<strong> guideline<\/strong>. However, this type of contract may not <strong>exceed a term of three years<\/strong>, which may be <strong>extended <\/strong>for an additional <strong>twelve months<\/strong> by a statewide collective bargaining agreement or, failing that, by a lower-level industry agreement.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Temporary contract due to production circumstances<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The contract may have a <strong>maximum duration of<\/strong> <strong>six months<\/strong>, within a period of twelve, counted from the moment in which the aforementioned causes occur. Its duration must be <strong>specified as from its conclusion.<\/strong><\/li>\n\n\n\n<li>In the event that the contract has been entered into for <strong>less than the maximum duration established<\/strong>, it may be extended once only by agreement of the <strong>parties<\/strong>, without the total duration of the <strong>contract exceeding said maximum duration.<\/strong><\/li>\n\n\n\n<li>At the end of the maximum term, without denunciation by either party, the contract will be<strong> extended for an indefinite term<\/strong> (unless the temporary nature of the contract is proven). Likewise, it&#8217;ll be <strong>transformed into an indefinite-term contract<\/strong> when, due to lack of registration with the Social Security, a period equal to or greater than the trial period has elapsed, if it&#8217;s given in fraud of the Law mentioned in the preceding paragraph (paragraph 1.c, art. <a href=\"https:\/\/www.iberley.es\/legislacion\/real-decreto-legislativo-2-2015-23-octubre-aprueba-texto-refundido-ley-estatuto-trabajadores-23860101\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">49 ET<\/a>).<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Extension of interim employment contract<\/strong><\/h3>\n\n\n\n<p>Contracts entered into for a <strong>term of less<\/strong> than the maximum term established by law or by <strong>agreement shall <\/strong>be understood to be tacitly extended, <strong>up to the maximum term<\/strong>, when there isn&#8217;t express denunciation or extension prior to their expiration and the <strong>employee continues to render services.<\/strong><\/p>\n\n\n\n<p>This type of contract has its<strong> own characteristics<\/strong>:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Substitution of the worker with right to reserve position: <\/strong>the duration of the contract shall be the duration of the absence of the substituted worker.<\/li>\n\n\n\n<li><strong>Covering of a job position until its definitive concession:<\/strong> If it is in a private company, &#8220;the duration of the <strong>selection or promotion process<\/strong> for the definitive coverage of the position cannot exceed <strong>three months<\/strong>&#8220;; if it&#8217;s in public administrations, &#8220;the duration of the contracts will coincide with the <strong>duration of such processes<\/strong> in accordance with the <strong>provisions of their specific regulations<\/strong>&#8220;.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Training and apprenticeship contracts<\/strong><\/h3>\n\n\n\n<p>The minimum term of the contract shall be <strong>one year and the maximum term shall be three years<\/strong>. However, <strong>collective bargaining agreements<\/strong> may establish different contract durations. The above, depending on the organizational or <strong>productive needs of the companies<\/strong>. However, the minimum duration may not be less than <strong>six months and the maximum duration <\/strong>may not exceed three years.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Extension of internship employment contract<\/strong><\/h3>\n\n\n\n<p>This type of <strong>contract may<\/strong> not be for less than <strong>six months<\/strong> or exceed <strong>two years<\/strong>; within these limits, the duration of the contract may be determined by industry-wide collective bargaining agreements.
